  6. Information about the Goods in the Store, in particular their descriptions, parameters and prices, constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code (Kodeks cywilny), not an offer.
  7. Before starting to use the Store, the Customer should read the Terms and the Privacy Policy. The Terms are available free of charge on the Store's website in a manner that allows them to be downloaded, saved and printed.

Such a person may declare when ordering whether the contract is of a professional nature for them; making the declaration is not a condition for concluding the contract (Article 7aa(2) of the Consumer Rights Act).
  5. Business — a natural person, a legal person or an organisational unit with legal capacity, conducting business or professional activity in its own name, that is not a Business with consumer rights.
  6. Buyer — a Consumer, a Business with consumer rights or a Business that has concluded a Sales Contract or a Contract for the Supply of Digital Goods with the Seller or has taken steps towards concluding one.

  16. Review — an assessment of, or description of experience with, Goods published by a Buyer in the Store.
  17. Durable Medium — a material or tool that makes it possible to store information so that it can be accessed for a period appropriate to its purpose and reproduced in unchanged form (e.g. an e-mail, a PDF file).
  18. Privacy Policy — the document on the processing of personal data by the Seller: https://slodkibufet.pl/en/policies/privacy-policy.

§ 3. Technical requirements and security

  1. To use the Store, the following are required: a device with internet access, an up-to-date web browser supporting JavaScript and cookies, and an active e-mail address. To use Digital Goods — a program for reading electronic files.
  2. It is prohibited to use the Store in a manner that disrupts its operation, in particular by means of viruses, bots, automation scripts or other harmful software.
  3. The Store runs over an encrypted connection (SSL/TLS) on the Shopify platform. Despite the security measures applied, using the internet involves risks, including infection of the device with malicious software, data theft (phishing) or unauthorised access to data. The Seller recommends using up-to-date antivirus software and not sharing the login codes sent by e-mail with other persons. The Seller never asks for a password or card details by e-mail or SMS.

§ 4. Rules for using the Store

  1. The Customer uses the Store in accordance with the law, the Terms and good practice, provides true data and does not supply unlawful content.
  2. Purchases can be made without creating an Account.
  3. Prices in the Store are gross prices in Polish zloty and include VAT. The delivery cost is stated when the delivery method is chosen, before the Order is placed.
  4. If in a single Order the Buyer purchases Physical Goods and Digital Goods, two contracts are concluded: a Sales Contract for the Physical Goods and a Contract for the Supply of Digital Goods for the Digital Goods. The relevant provisions of the Terms apply to each.

§ 5. Account (Account Service)

  1. The contract for the provision of the Account Service is concluded for an indefinite period upon the first login to the Account. Login takes place by means of a one-time code sent to the Customer's e-mail address or through a third-party login service available on the login page (e.g. Shop). The service is free of charge.
  2. In the Account, the User may in particular view placed Orders and their status and save delivery details.
  3. Maintaining the conformity of the Account Service with the contract does not require the User to install updates.
  4. If the Seller does not make the Account available immediately after the contract is concluded, the User calls on the Seller to do so by e-mail. If the Seller does not make the Account available immediately after being called upon, the User may withdraw from the contract; the User may also do so without a prior call in the cases set out in Article 43j(5) of the Consumer Rights Act.
  5. The User may at any time, without giving any reason, terminate the contract for the provision of the Account Service with immediate effect, and a Consumer and a Business with consumer rights may also withdraw from it within 14 days of its conclusion. It is enough to write to kontakt@slodkibufet.pl. The Seller deletes the Account immediately, no later than within 14 days.
  6. If the User uses the Account in breach of the law, the Terms or good practice, or supplies unlawful content, the Seller may terminate the contract with 7 days' notice, by a statement sent by e-mail. During the notice period the Seller may block access to the Account if this is necessary to prevent further infringements. The User may appeal against such a decision under the rules in § 17(10)–(11).
  7. Blocking or deleting the Account does not affect the performance of contracts concluded earlier.

§ 6. Newsletter and other electronic services

  1. Newsletter — the sending of commercial information by e-mail and, after separate consent is given, also by SMS. The contract is concluded for an indefinite period at the moment the Customer gives consent (by ticking a box or signing up in a form). Consent is voluntary and is not a condition of purchase. Unsubscribing is possible at any time via the link in the message, by replying “STOP” to an SMS or by e-mail to kontakt@slodkibufet.pl.
  2. Order form — a contract concluded for the duration of placing the Order; it ends when the Order is placed or abandoned.
  3. Contact form and chat — the possibility of sending a message to the Seller; the contract ends when a reply is given.
  4. Back-in-stock notifications (if available in the Store) — a message about the renewed availability of the indicated Goods; the service ends when the notification is sent or upon unsubscribing.
  5. The rules of the affiliate programme are set out in separate terms: https://slodkibufet.pl/pages/regulamin-programu-partnerskiego.

§ 7. Goods and prices

  1. For each item of Goods we state its main characteristics and, for food products, the information required by the rules on the provision of food information to consumers (including the name, the list of ingredients with allergens emphasised, the net quantity, the nutrition declaration, storage conditions where required, and the name and address of the responsible food business operator). The best-before date is on the packaging.
  2. The photos show the actual appearance of the Goods. Sprinkles are mixtures of elements, so their arrangement and proportions in a particular package may differ slightly from the photo.
  3. With every announcement of a price reduction we state the lowest price of the Goods in the 30 days before the reduction was introduced.
  4. The Seller does not use prices personalised on the basis of automated decision-making.
  5. The Seller may change prices and the offer. The change does not apply to Orders placed earlier.

§ 8. Order and conclusion of the Sales Contract

  1. Orders can be placed 24 hours a day. The Store sells with delivery only within the territory of Poland.
  2. To place an Order, the Buyer:
    1. adds Goods to the Cart and proceeds to checkout,
    2. provides their first name and surname, e-mail address, telephone number and delivery address and, if they need a company invoice, the company name and NIP (tax identification number),
    3. chooses the delivery and payment method,
    4. may give separate, voluntary marketing consents,
    5. clicks the button indicating an obligation to pay (e.g. “Pay now” or “Place order”).
  3. Before clicking the button, the Buyer sees a summary: the Goods, the total price including taxes, the delivery cost and the selected payment and delivery methods.
  4. Clicking the button means placing the Order, i.e. an offer to conclude a contract. The Seller sends the Buyer an e-mail confirming acceptance of the Order. The contract is concluded at the moment the Buyer receives this confirmation. The Buyer receives confirmation of the conclusion of the contract — with a summary of the Order, the Seller's details and the key information on the right of withdrawal (including its exclusions), complaints and contact — on a Durable Medium in the body of that e-mail, no later than at the time the Goods are delivered. The Terms can be downloaded and saved from the Store's website at any time.
  5. If the Order cannot be fulfilled (e.g. the Goods turned out to be unavailable), the Seller immediately informs the Buyer of this by e-mail, proposes a solution or refunds the payment received for those Goods within 14 days.
  6. For cash on delivery, the contract is concluded subject to a condition subsequent: failure to collect the parcel and pay the price results in termination of the contract.

§ 9. Payments

  1. Available payment methods (the current ones are always visible when placing the Order):
    1. payment cards: Visa, Mastercard,
    2. e-wallets: Apple Pay, Google Pay,
    3. Viva Wallet — payment by card or another method indicated on the Viva Wallet payment page,
    4. payment on delivery (cash on delivery) — on receipt of the parcel from the InPost courier, in the form permitted by the carrier.
  2. The online payment service providers are: Viva Payment Services S.A. with its registered office in Athens (Greece) — for payments through Viva Wallet — and Stripe Payments Europe, Limited with its registered office in Dublin (Ireland) — for payments by card and e-wallet on the order page.
  3. For online payment, payment must be made within 5 Business Days of placing the Order. After this period expires without payment, the Seller may, within the following 7 days, withdraw from the contract by sending the Buyer a statement by e-mail.
  4. Refunds are made by the Seller using the same means of payment as used by the Buyer, unless the Buyer has expressly agreed to another means of refund that does not involve any costs for them. Where funds need to be refunded for a transaction made by payment card, the Seller makes the refund to the bank account linked to the Buyer's payment card. For cash on delivery, the refund is made by transfer to the bank account indicated by the Buyer. The Buyer does not bear any costs of the refund.
  5. The Seller issues VAT invoices on request made with the Order (NIP field). The Buyer agrees to receive the invoice electronically. Invoices for Businesses are issued in the National e-Invoice System (Krajowy System e-Faktur, KSeF) where required by law — which is why the NIP must be provided with the Order; it cannot be added after the receipt has been issued.

Mastercard and Visa

§ 10. Delivery and processing time

  1. Delivery takes place only within the territory of Poland. Delivery methods and costs (as at 22.10.2026):
    Delivery method Cost
ORLEN Paczka (pick-up point) 9,99 zł
InPost Paczkomat 24/7 (parcel locker) 12,99 zł
    InPost courier 14,99 zł
InPost courier — payment on delivery 19,99 zł
Products worth at least 200 zł free delivery (any method, including cash on delivery)

The current costs are always visible when placing the Order, before it is confirmed. The Buyer pays the delivery cost together with the price of the Goods.
  2. Order processing time (preparing and dispatching the parcel) is 1 Business Day. It is counted:
    • for online payment (card, Apple Pay, Google Pay, Viva Wallet) — from the moment a positive payment authorisation is obtained,
    • for cash on delivery — from the sending of the confirmation of acceptance of the Order to the Buyer.

We usually ship Orders paid on a Business Day by 14:00 on the same day.
  3. Delivery time by the carrier is usually 1–2 Business Days from dispatch. Before holidays and during large promotions the processing time may be longer; we announce this on the Store's website.
  4. After the parcel is dispatched, the Buyer receives an e-mail with the tracking number and the name of the carrier.
  5. The Seller is responsible for delivering Goods that conform to the contract and are in undamaged condition. Please check the parcel on receipt; if it is damaged, it is advisable to draw up a damage report with the carrier and to write to us. This is not a condition for a Consumer to submit a complaint.
  6. If the parcel is returned to the Seller uncollected, the Seller contacts the Buyer and arranges re-dispatch (the cost of re-delivery is borne by the Buyer) or refunds the amount paid in the manner described in § 9(4).

§ 11. Right of withdrawal from the Sales Contract

  1. The provisions of this section apply to Consumers and Businesses with consumer rights.
  2. The Buyer may withdraw from the Sales Contract without giving any reason within 14 days of the day on which they, or a third party other than the carrier indicated by them, took possession of the Goods; for several Goods delivered separately — from taking possession of the last of them. To meet the deadline, it is sufficient to send the statement before it expires.
  3. The statement of withdrawal may be made in any form, in particular:
    1. by e-mail to kontakt@slodkibufet.pl — preferably with: first name and surname, e-mail address, Order number, indication of the Goods, a clear statement of withdrawal and, in the case of a Business with consumer rights, the NIP number or PKD codes; the absence of these details does not invalidate the statement,
    2. by post to: SŁODKI BUFET ANNA KACZOR, ul. Jarnołtowska 15, 54-530 Wrocław,
    3. using the form constituting Annex 1 or the model form set out in Annex 2 to the Consumer Rights Act (this is not mandatory).
  4. The Seller immediately confirms receipt of the statement by e-mail.
  5. The Buyer returns the Goods to the address in paragraph 3 point 2 immediately, no later than 14 days from the day of withdrawal; it is sufficient to dispatch the parcel before this period expires. We do not accept cash-on-delivery parcels. The Buyer bears only the direct cost of returning the Goods.
  6. The Seller refunds all payments received, including the cost of delivery to the Buyer (up to the cost of the cheapest standard delivery method offered in the Store), immediately, no later than within 14 days of receiving the statement. The Seller may withhold the refund until it receives the Goods or proof of their return, whichever occurs first. The refund is made in the manner described in § 9(4).
  7. The Buyer is liable for any diminished value of the Goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning.
  8. The right of withdrawal does not apply to:
    1. food Goods supplied in sealed packaging which cannot be returned after opening for health protection or hygiene reasons, if the packaging was opened after delivery (Article 38(1) point 5 of the Consumer Rights Act). Our food products have a factory seal under the cap — sprinkles, decorative sugars and decorative elements: a foil heat-sealed to the rim of the jar; glitters, edible colourings and drips: a sealing liner closing the packaging. The packaging is deemed opened when this seal has been torn, pierced or tampered with;
    2. Goods that are liable to deteriorate rapidly or have a short shelf life (Article 38(1) point 4) — if such Goods appear in the offer, this information will be stated with them;
    3. Goods made to the Buyer's specifications or clearly personalised to meet their individual needs (Article 38(1) point 3) — if such Goods appear in the offer.

Unopened food Goods and decorating stencils (including unpacked ones) can be returned under the rules in paragraphs 1–7.
  9. If the Buyer received free Goods as part of a promotion and, after withdrawal from the contract (in whole or in part), the conditions of the promotion are no longer met — e.g. the value of the retained Goods is lower than required — the Buyer also returns the free Goods. If the Buyer does not return them or the packaging of free food Goods has been opened, the Seller may demand payment of their regular price in the Store, including by deducting it from the refund amount.

§ 12. Complaints about Physical Goods (lack of conformity)

  1. Paragraphs 2–13 apply to Consumers and Businesses with consumer rights.
  2. The Seller is liable for a Lack of Conformity existing at the time the Goods were delivered and becoming apparent within 2 years of that time or, if the shelf life of the Goods specified by the Seller or the manufacturer is longer, within that period (Article 43c of the Consumer Rights Act). A Lack of Conformity that becomes apparent within 2 years is presumed to have existed at the time of delivery, unless the Seller proves otherwise or the presumption is incompatible with the nature of the Goods.
  3. In the event of a Lack of Conformity, the Buyer may demand replacement of the Goods (or repair, if possible). The Seller may replace the Goods instead of the requested repair (or vice versa) if the chosen remedy is impossible or would involve excessive costs; it may also refuse to bring the Goods into conformity if both remedies are impossible or would involve excessive costs.
  4. A complaint can be submitted by e-mail to kontakt@slodkibufet.pl or in writing to the address in § 1(2). Please provide: first name and surname, e-mail address, Order number, date of delivery, a description of the Lack of Conformity and the date it was noticed, and the demand and, if possible, a photo of the Goods and of the label with the batch number. The absence of any of these elements does not result in rejection of the complaint.
  5. The Seller responds to the complaint on a Durable Medium (by e-mail) within 14 days of receiving it: it accepts it and states the date by which the demand will be met, informs of replacement instead of repair (or vice versa), refuses to bring the Goods into conformity for the reasons in paragraph 3, or rejects the complaint as unfounded. Failure to respond within this period means the complaint is accepted.
  6. The Seller brings the Goods into conformity at its own expense, within a reasonable time and without significant inconvenience to the Buyer. The Buyer makes the Goods available and the Seller collects them at its own expense (we will explain how to send the parcel at no cost to the Buyer). The Buyer does not pay for normal use of Goods that were subsequently replaced.
  7. The Buyer may make a statement of price reduction or of withdrawal from the contract where:
    1. the Seller has refused to bring the Goods into conformity for the reasons in paragraph 3,
    2. the Seller has not brought the Goods into conformity in accordance with paragraph 6,
    3. the Lack of Conformity persists despite an attempt to bring the Goods into conformity,
    4. the Lack of Conformity is so significant that it justifies a price reduction or withdrawal without first demanding replacement or repair,
    5. it is clear from the Seller's statement or the circumstances that it will not bring the Goods into conformity within a reasonable time or without significant inconvenience to the Buyer.
  8. The statement under paragraph 7 is made by e-mail or in writing; please provide the details as in paragraph 4, the reason from among those listed in paragraph 7 and, for a price reduction, the amount of the reduced price.
  9. The reduced price must be in the same proportion to the contract price as the value of the non-conforming Goods bears to the value of conforming Goods. The Seller refunds the difference immediately, no later than within 14 days of receiving the statement.
  10. The Buyer may not withdraw from the contract if the Lack of Conformity is minor (it is presumed to be significant).
  11. After withdrawal from the contract, the Buyer immediately returns the Goods at the Seller's expense, and the Seller refunds the price immediately, no later than within 14 days of receiving the Goods or proof of their return, in the manner described in § 9(4).
  12. A complaint about opened food Goods is possible — the exclusion in § 11(8) applies only to withdrawal without giving a reason.
  13. The Seller does not provide a commercial guarantee for the Goods, unless information about one is given with the Goods.
  14. In relation to Businesses, the Seller's liability under the statutory warranty (rękojmia) for defects is excluded (Article 558 § 1 of the Civil Code). The Seller will nevertheless consider a report of Goods damaged in transit or not matching the Order, submitted within 7 days of delivery.

§ 13. Digital Goods (e-books)

  1. To purchase Digital Goods, the Buyer proceeds as in § 8(2) (without choosing delivery). The Contract for the Supply of Digital Goods is concluded in accordance with § 8(4).
  2. The Seller supplies Digital Goods as a download link sent by e-mail immediately after the payment is credited. If the link does not arrive within 24 hours, please contact us.
  3. If the Seller does not supply the Digital Goods immediately, the Buyer calls on the Seller to do so by e-mail; if the Seller does not supply them immediately after being called upon or within an additional, expressly agreed period, the Buyer may withdraw from the contract (Article 43j of the Consumer Rights Act). The Seller refunds the price within 14 days of receiving the statement, in the manner described in § 9(4).
  4. Digital Goods are supplied once and are not subject to later updates.
  5. Right of withdrawal without giving a reason: a Consumer and a Business with consumer rights may withdraw from the Contract for the Supply of Digital Goods within 14 days of its conclusion. This right expires if the Seller has begun supplying the Digital Goods with the express and prior consent of the Buyer, who was informed before the supply began that once it has been performed they will lose the right of withdrawal, acknowledged this, and the Seller confirmed this on a Durable Medium (Article 38(1) point 13 of the Consumer Rights Act).
  6. After withdrawal from the contract, the Buyer stops using the Digital Goods and does not make them available to other persons (Article 34(1a) of the Consumer Rights Act).
  7. Licence: upon payment, the Seller grants the Buyer a non-exclusive licence to use the Digital Goods, for an indefinite period, covering: saving on their own devices, displaying and reproducing, and printing for their own use. The Buyer may use the knowledge and recipes from the e-book in their private life and in their own business. The licence does not cover making available, reselling or distributing the Digital Goods in whole or in part, or granting sublicences, subject to permitted use under the Act on Copyright and Related Rights (ustawa o prawie autorskim i prawach pokrewnych).

§ 14. Complaints about Digital Goods and the Account Service

  1. The provisions of this section apply to Consumers and Businesses with consumer rights.
  2. Digital Goods must conform to the contract at the time of supply, and the Account Service — throughout the period of its provision. The Seller is liable for a Lack of Conformity of Digital Goods that becomes apparent within 2 years of supply, and for a Lack of Conformity of the Account Service that becomes apparent during its provision.
  3. In the event of a Lack of Conformity, the Customer may submit a complaint demanding that conformity be restored — by e-mail to kontakt@slodkibufet.pl (please provide your first name and surname, e-mail address, a description of the Lack of Conformity and the demand). The Seller may refuse if bringing into conformity is impossible or would involve excessive costs.
  4. The Seller responds to the complaint by e-mail within 14 days of receiving it; failure to respond means the complaint is accepted. After acceptance, the Seller brings the Digital Goods or the Account Service into conformity at its own expense, within a reasonable time and without significant inconvenience.
  5. The Customer may make a statement of price reduction or of withdrawal from the contract in the cases corresponding to § 12(7) (bringing into conformity impossible or excessively costly, ineffective, the Lack of Conformity significant, or the Seller clearly does not intend to remedy it). For the Account Service — which is free of charge — only withdrawal is available.
  6. The Seller may not demand payment for the time during which the Digital Goods were not in conformity with the contract. The reduced price is in the proportion set out in § 12(9); the refund is made within 14 days of receiving the statement. Withdrawal from the contract is not possible if the Lack of Conformity is minor.

§ 15. Promotions, discount codes and free gifts

  1. The Store may run promotions, including discounts, discount codes and free Goods added to Orders that meet specified conditions (e.g. a minimum value). The detailed terms of each promotion (duration, conditions, limit) are stated on the Store's website while it runs.
  2. Unless the terms of the promotion provide otherwise: discount codes and promotions cannot be combined, a single promotion can be used once per Order, and one free item of Goods per Order is granted under a single promotion.
  3. Free Goods are added to the Cart automatically. If, despite the conditions being met, they were not included in the Order or the parcel, please report it to kontakt@slodkibufet.pl — after checking the Order (including the photo of the packed parcel, which we keep for 14 days) we will send them free of charge.
  4. The Seller may remove from the Order free Goods added as a result of a system error if the Order does not meet the conditions of the promotion, informing the Buyer of this before dispatch.
  5. The terms of an ongoing promotion are not changed to the detriment of Customers who have already taken advantage of it. § 7(3) applies to every price reduction.

§ 16. Gift Cards

  1. A Gift Card is an electronic voucher with a value chosen at purchase, sent by e-mail as a code. It can be used to pay for Goods in the Store in whole or in part; any unused amount remains on the Card.
  2. The Card is valid indefinitely.
  3. The Card cannot be exchanged for cash or other means of payment. The Card cannot be used to pay for another Gift Card.
  4. The Card code works like cash: anyone who knows it can use it. The Seller is not liable for use of the code by a person to whom the Customer disclosed it. If the code has been lost, the Seller may block it and issue a new one for the remaining amount after the purchase is confirmed.
  5. A Consumer may withdraw from the contract for the purchase of the Card within 14 days of receiving the e-mail with the Card, if the Card has not been used. On withdrawal from a contract for the purchase of Goods paid for with the Card, the refunded amount is returned to the Card.

§ 17. Reviews of Goods

  1. Buyers may publish Reviews of Goods. We collect and display Reviews through the Judge.me app.
  2. How we verify Reviews:
    1. we send a request to write a Review by e-mail only to persons who have purchased the Goods in the Store, after the Order has been fulfilled;
    2. a Review receives the “Verified Buyer” badge only if Judge.me confirms that the author's e-mail address is linked to an actual Order in the Store;
    3. Reviews without this badge have not been verified in this way;
    4. we publish both positive and negative Reviews, we do not buy Reviews and we do not commission them to be written;
    5. if a loyalty programme operates in the Store, its participants may receive points for writing a Review — in the same number regardless of the rating and content of the Review; the award of points does not depend on whether the Review is positive.
  3. It is prohibited to include in Reviews: false or unlawful information; content inciting violence or hatred, or insulting content; content infringing personal rights, copyright, image rights or other rights of third parties; personal data of other persons; advertisements and content promoting competitors; political or religious content unrelated to the Goods.
  4. The author is responsible for the content of the Review. By publishing a Review, the author grants the Seller a free, non-exclusive licence to use it, without territorial limitation and for an indefinite period, covering recording, reproduction and distribution: in the Store, in the Seller's social media channels, in the Seller's marketing materials and by passing the Review and rating to Google services for the purpose of displaying product ratings — with the right to shorten the Review without changing its meaning. The Review is signed with the author's first name and the first letter of their surname.
  5. Reporting a Review — anyone who considers that a Review contains unlawful content or breaches the Terms (the “Notifier”) may report it by e-mail to kontakt@slodkibufet.pl, providing: an explanation of why the content is unlawful or incompatible with the Terms; the exact address (URL) of the Review and information allowing it to be identified; their first name and surname or name and e-mail address (except for reports concerning offences referred to in Articles 3–7 of Directive 2011/93/EU); a statement that the report is made in good faith and that the information in it is accurate and complete.
  6. The Seller confirms receipt of the report by e-mail. If the report is incomplete, the Seller may ask for it to be completed within 14 days; a report that is not completed may be left unconsidered.
  7. The Seller considers a complete report within 14 days. Until it is considered, the Seller may hide the Review. After consideration, the Seller removes a Review that infringes the law or the Terms, or restores a Review that does not infringe them.
  8. The Seller informs the Notifier and the author of the Review (if it knows their e-mail address) of the decision, giving a statement of reasons: what measure was applied (removal, hiding), the facts and circumstances on which the decision was based, whether the decision was taken on the basis of a report or on the Seller's own initiative, whether automated tools were used, the legal or contractual basis, and information on the possibility of appeal.
  9. The Seller may also, on its own initiative, hide or remove a Review that infringes the law or paragraph 3, applying paragraph 8. A Review is not removed or hidden merely because it is negative. The Judge.me app may automatically publish Reviews or hold them for checking according to the Store's settings (e.g. a prohibited-words filter); the decision to hide or remove a Review is taken by a human.
  10. Appeal — the author of a removed Review or a Notifier whose request to remove a Review was refused may appeal against the decision by e-mail to kontakt@slodkibufet.pl or in writing to the address in § 1(2), providing their first name and surname or name, contact details and the grounds.
  11. The Seller confirms receipt of the appeal and considers it within 14 days; appeals are considered by a human, not by an automated system.
  12. Paragraphs 5–11 apply accordingly to other content supplied by Customers and to decisions under § 5(6).

§ 20. Personal data

  1. The controller of the Customers' personal data is the Seller (§ 1(2)). We process data in accordance with Regulation (EU) 2016/679 (GDPR):
    • to conclude and perform contracts and maintain the Account (Art. 6(1)(b) GDPR),
    • to comply with legal obligations, e.g. tax and accounting obligations, and to handle complaints (Art. 6(1)(c) GDPR),

  2. Providing data is voluntary but necessary to place an Order (first name, surname, delivery address, e-mail, telephone).
  3. Details — recipients of the data, retention periods, transfers outside the EEA, the Customer's rights and cookies — are described in the Privacy Policy: https://slodkibufet.pl/en/policies/privacy-policy.

§ 21. Changes to the Account Service

  1. The Seller may change the Account Service if this is required to adapt it to new devices or software, to improve or extend its functions, or by a legal obligation. The change does not involve any costs for the User.
  2. The Seller announces the change in the Account or by e-mail.
  3. If the change significantly and negatively affects access to or use of the Account Service, the Seller informs the User by e-mail, at least 7 days before the change, of its characteristics and timing and of the right to terminate the contract with immediate effect within 30 days of the change being made.

§ 22. Changes to the Terms

  1. The Seller may change the Terms for important reasons: a change in legislation or its interpretation, a court ruling or a decision of an authority, a change in the Seller's details, a change in the scope of business or the services offered, a change in payment or delivery methods, a technical change to the Store, prevention of abuse, or removal of ambiguities.

§ 23. Final provisions

  1. Contracts are concluded in Polish. The governing law is Polish law; the choice of law does not deprive the Consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.
  2. The provisions of the Terms do not limit the rights of Consumers and Businesses with consumer rights arising from mandatory provisions of law; in the event of conflict, those provisions apply.
  3. Disputes with Businesses are resolved by the court competent for the Seller's registered office.
